    Default Regaining Temporary Custody

    My question involves guardianship in the State of: Colorado
    I have a 3 year old son, the father and I have been together since I was 18 I am now 23. The baby's father went to prison for 2 years. While he was gone I took the baby and went to live with my boyfriends mother. After a while I started going out and taking drugs. My boyfriends mother talked me into giving her temporary custody. after I did she kicked me out of the house and every time I tried to see the baby, she would make an excuse as to why I couldn't see him, then she told everyone that I never tried to see him. Now, my boyfriend is out of prison and has to stay in Arizona for 2 more years. I am doing good, I am working everyday and have been clean for 4 months. I miss my baby. My boyfriend and I are no longer together. I want to go home to Arizona where my family lives, here I have no one, except my baby. I don't want to leave my baby, now my boyfriends Mom told me she is moving to another city and taking the baby with her. I cant move with them and that means I will never get to see him. I know 4 months straight is not long enough. But what can I do to get the baby back and bring him with me to Arizona, my family will help me and help me take care of my baby, plus that is where his Dad is and he will, also help with the baby. But my baby's Grandmother will not allow that. What can I do???
    We did not go before a judge to sign the temporary custody papers only an attorney. Also she made sure the babies father signed over Temp Custody too.

    Unless it was signed by a judge, it's not legally binding. You can literally go and take your child.

    However you should be prepared for Grandma to file for custody and she'd stand a pretty good chance. She has been your son's primary caregiver and the court will look at what is in HIS best interest - not yours, not Grandma's, but his.
