    Default When Can Multiple Felonies Be Expunged

    My question involves criminal records for the state of: Kansas

    I’m writing on behalf of my brother, who is under the impression he cannot have multiple felonies expunged. After reviewing the answers on this site, and other sources on the internet, I now wonder if he’s misinformed.

    He moved from Kansas out to California shortly after his last incarceration. It was the best thing he did and he’s been able to turn his life around. He cannot find a job, though. It all goes well until the background check. That said, his employment history is weak and thin. If this is a factor in the expungement process I can see it being an issue. I’ve listed the details of his felonies. Please let me know if you think it’s worth pursuing.

    The statute, KRS 21-6641b, speaks for itself. The issue is not whether it's theoretically possible for somebody with multiple felony convictions to get expungements, assuming their conviction charges aren't excluded from eligibility and that the statutory waiting period has passed. It's that it's exceptionally unlikely that somebody with multiple convictions is going to be deemed by a judge to qualify - the judge must find that "the circumstances and behavior of the petitioner warrant the expungement" and that "the expungement is consistent with the public welfare".

    Thanks for your response, Mr. Knowitall. You confirmed what we were afraid of - while it may be possible, it’s not probable.

    After 10 yrs of struggling to find a job (and not being the 1st one on the chopping block when layoffs arrive) he’s become pretty depressed about the whole situation. He’s still on the up & up but I can see why felons might resort to old habits to make ends meet. Sorry for the vent. I know he’s not the only one in this predicament.

    Good luck to others out there. If anyone with multiple Kansas felonies gets them expunged please let me know.
