Getting a Duplicate Title After Wreck

My question involves vehicle registration or title in the state of: MS

In 2010, I took out a tile cash loan on my vehicle. I paid off regularly at first, but then got laid off. Since that time, I have worked but never made enough to pay back the loan in full. Each time I was getting to that point something would happen such as loss of job or surgery that put me back out of work. Eventually over the time I forgot I even had the title loan. As time went by, other members of the house used the vehicle to work out of and keep the bills going. Well here this week, another driver hit me and the car is getting totalled by the driver's insurance company. The insurance company wants a title to the car on monday, at which time they will write a check for the damages for the vehicle so we can get a replacement to work out of. When they asked for the title, I began trying to remember where it was and I recalled the title loan. I called the title loan company, and they told me they had written off the loan in 2011. They say they no longer have a title there for it, but their main office should but that it will have to be paid off first before it can be released to me. The remaining balance is $712. My questions are:
1. Can i get a duplicate title from the state so that I can get that check?
2. Since I want to pay the balance, can the insurance company simply cut them a check for the $712 since I do not have it to pay prior to getting the settlement from the insurance company?
3. I am just wanting a duplicate. It is fine with me if the lien is still on the duplicate. Can I get a duplicate or will the loan have to be paid for me toi get a duplicate?
4. What is my best options on this. There is an office in my state capital that will give me a copy over the counter. I do not have the $712 to pay the title loan until the insurance pays first.

Thanks for any advice. I just started working a good job and cant afford not to have a way to work again

Not if the loan place actually filed for a lien on the title.

You can ask but they may have a problem with this method without you delivering the title to them in exchange for the check.

In your state apparently the lien holder holds the title. That means you cannot get a title if there is a lien on it.

well, that is a problem.

It's a conundrum; you can't get the title until you pay off the lien, you can't pay off the lien until you get the check, you can't get the check until you get the title.


I would try a couple things;

borrow the $712 from somebody

tell the insurance company there is a lien on the title and you cannot get the title without paying off the lien first and you can't payoff the lien...well, I think you know where I'm going. Maybe they can confer with the loan place and work it out between them.
