My question involves a child custody case from the State of: Louisiana
My ex-husband and I divorced 10yrs ago and agreed upon a visitation schedule for our three children. I gave Domiciliary custody to my ex husband because our family home was on his family property. Now over the past 10 yrs we both remarried and for some reason or another, my two oldest decided not to come on visitation. However, my youngest (who is 12 yrs old) wants to come all the time and every chance he gets. For the past year and half, my ex and I haven't stuck to the visitation agreement. Couple weeks ago my ex husband got upset with me because he wanted to pick our son up a couple days early from our agreed upon month with me. My son got upset because he didn't want to leave on the time his father wanted because that wasn't what both his father and I agreed upon. Now he wants to come back this weekend (just for the weekend) and my ex husband is telling me that it isn't my weekend and that he can't. At what age can a child make the decision when and how long they want to stay with the non-custodial parent if it isn't interfering with school?
