My question involves a child custody case from the State of: Oregon, Florida & Minnesota
The biological father & I owned a home in Florida, our place of residence for 18 months. My daughter, age 5, and I were visiting family in Oregon while my partner was securing a transfer to Oregon, our agreed location best for raising our daughter. With his approval, a home was rented & furnished in order to solidify a routine. While we awaited his arrival, her father decided to move to Minnesota. He quick claim deeded the Florida home and debt to me, packed only his personals and relocated with no intention of our joining him. My child and I have now lived in Oregon for 11 months. Her father would like our daughter to live in Minnesota (not residing as a family) or at least would like her to stay with him for extended periods. We have gone to mediation and formed a parenting plan in which he agreed to no out of state travel without my presence for 2 years. We have not yet, by agreement, involved the courts. Can he, if he files first, obtain custody? If not, would the courts award him extended visits outside of her home state?
