    Exclamation All Tenants Must Move Cars Across Lot After 4am but Before 7am or Be Towed

    My question involves landlord-tenant law in the State of: Washington

    Hello everyone, I live in an apartment complex with 186 units. They have approximately 200 open spaces, 8 handicap spaces, and 100 carports that can be rented separately. Approximately two weeks ago they posted notice both on our doors and in common areas that they would be resealing the parking lot, but when the time came they postponed it due to weather. Now last Saturday they put notices in our door jams , but not in common areas like before that they would be resealing the lot on Tuesday and Wednesday, half the lot per day. We had to have our cars moved out of the half they're working on by 7am each day or be towed. We moved our cars so we weren't towed but many tenants were towed, starting at 7am, and they say they didn't get the notice. Now at about 6:00PM the side they did today was still roped off so people coming home from work couldn't park and many have double parked. The assistant manager is standing out there and informing people that ask him that the other side won't be opened until 4am, and we must still move our cars over there by 7am or they will be towed. So all tenants have a 3 hour window to move our cars or they will tow them. On top of all this, because of all the double parked cars which the assistant manager is allowing, a fire truck could never get near my building if they needed to. There's was an arson here a couple of weeks ago too.

    Is the management breaking the law by doing this? Thank you.

    as far as the fire lane; maybe. To the rest; no. If you are concerned about the towing; they gave you several days notice and in a manner that is actually more proper than the first time. While a notice in a common area might be missed, unless a person is a recluse and doesn't leave their house since Saturday, they would have gotten the notice.

    so, how about they do this:

    NO PARKING ALLOWED IN THE LOT FROM JULY 11 to JULY 13.

    would that make you happier? Seriously, sometimes life isn't perfect. We adjust. It isn't like this is a long term intrusion in your life and it is intended to make your residence better.

    If you don't see something in your door jam, what's to say that you'd see it in the "common areas"? No law would obligate posting in common area.

    They could have said the night before vs. giving you all until 7a day of.

    Technically speaking, they could tell you all that you need to take your car altogether off-site. Sure, it's inconvenient and a hassle, but ...

    If residents don't care about breaking the law by parking in a fire lane (can't blame their bad decision on "assistant manager is allowing"), then they could expect the fire folks to move their cars by force if need be (or just bust windows and run lines through their car). Fire department won't let cars being in the way stop them, and histrionics about what might happen aren't productive anyway.

    No (even as to fire lane, that's up to the stupid vehicle owners; they're the ones who'd get the tickets and damage to their car if they decide to move there and fire department needs the space).
