    Default What Happens at a Defense Deposition in an Accident Case

    My question involves an injury that occurred in the state of: NC

    I have a deposition coming up with the negligent parties attorney...what should I expect from them??? Will they be willing to negotiate, will they be hostile...how should i respond??? I plan to tell the truth...its pretty clear cut and the blame is indisputable, everything is in my opinion, but I know about defense attorney's and how crafty they can be. This is all new to me...I just want to be fully prepared...this site has been a great resource as I seek compensation for my pain and suffering...my lawyer plans to prepare me aswell, but with the info I've found on this site and throughout the web I've learned many things my lawyer neglects to tell me. I guess this is due to so many people failing to take the initiative and find out as much as possible. I get the impression people just go for whatever a lawyer tells them. Anyway, thanks for the previous help and any info about the deposition will be greatly appreciated. Thanks again.

    a deposition is not a meeting for negotiation although a good attorney will never turn down an opportunity to make a deal if it is there.

    I'm presuming you have an attorney. Basically, you listen to your attorney. You answer only what is asked, nothing more. You do not elaborate or expand on anything unless specifically asked.


    It should be a very simple affair. You, your attorney, and a recorder set around a table. The other attorney asks you questions. You give answers. When your lawyer smacks you upside the head and gives you a dirty look, you stop talking. There is no reason for hostility and no place for it. It should be a simple question and answer affair.
