    Default Bankruptcy and Credit

    My question involves bankruptcy in the state of: Georgia

    At a very early age I learned the buying power of credit and like most teens I ruined it.
    By 18 years old I had a credit score of 726, and I bought a brand new Lexus off the lot at 0% down and excellent interest rate.
    In addition to that, my mother bought a rental property in my name that ended up foreclosing as the mortgage was too high and the rent paid was too low.
    I accrued credit card debt to over $30,000. I ended up foreclosing that house, and selling that car.
    I attempted a chapter 7 with a completely amateur lawyer and she failed miserably.
    The bankruptcy was denied because "she neglected to submit necessary paperwork". At that point, I packed my bags
    and flew to a remote area of Australia to escape, wipe my tears, and recharge. I left many bills open and probably an overdraft
    on numerous checking accounts. I am now 23. I wish this story were made up.

    I plan to return to America, back to my home State of Georgia. I will absolutely need a car.
    I have NO assets to my name any longer. My plan is to file Chapter 7 on a clean slate.
    I am MUCH more fiscally responsible and plan to rebuild my life; this time without my mom
    using my name or buying a ridiculous car at a ridiculous age. My question is: where do I go
    from here? I have heard of swapalease.com but I don't know if my credit is relevant since it's a swap.
    I'm sure it is and if it is, I will for sure be denied. I have also heard of roadloans.com but I really don't
    want to pay outrageous APRs, although I know with my situation I may not have a choice.

    I would highly appreciate any advice on whether:
    1) Buy / Lease before filing chapter 7? During? After? More specifically referring to the auto loan itself for the aforementioned.
    2) I paid $722.00 per month on the car never ONCE being late for over 2 years, before I started to fall behind. The car never got repossessed, I sold it as I said.
    Could this history benefit me possibly? I heard dealerships have a separate credit file they pull based on AUTO history. I'm sorry this question is so car-related as this is a legal forum.
    3) Does my previous failed filing for Chapter 7 affect me in any way? It was completely the lawyer's fault and she refunded me 100%.
    4) I think it's safe to say that my credit is BEYOND "bad". I left the country with so many open doors. Maybe it would perhaps be best if I filed FIRST? The only thing is that
    in my town, there is no public transportation. The only part of Georgia with public transportation is mid or downtown Atlanta which I will not be residing in. I need a car ASAP and
    I can't rent a car for a month as that would cost me nearly a thousand dollars; a HUGE waste of money. Please help guide me down the right path. Do I file first, then apply for auto loans DURING the bankruptcy? If I wait till after...who knows how long it will take and I can't go that long on a rental car.

    good luck with either one. I suspect you will be relegated to a buy here pay here lot or some similar exorbitantly high interest rate situations.

    and that means what in the big picture? Your entire credit history will be reviewed when applying for credit.

    sure. It allowed the bad credit to remain bad credit all this time. It's like a festering sore. Bankruptcy is the medicine used to make it heal. You failed to apply the medicine that would have helped. It's

    why do you believe you can file bankruptcy before returning. You are not a resident of any state or even the US.

    I think something you have ignored is the possibility of criminal charges for bad checks. You really might want to investigate your criminal history before even bothering to consider coming back to the US.

    Your arrogance is unbelievably humorous as everything you said is completely moot. I never said I would file before coming back to the States, as I'm sure that's impossible. I hadn't written a check in two years prior to leaving the country, so no, there are no bad checks. In regards to my clean payment history for two years with Lexus, I mentioned that to ask about potential dealerships who favor AUTO history over CREDIT history. I think what YOU'VE ignored is the fact that your barely witty responses are not what people look for when they come to forums for advice. There's not a single point you said that serves as beneficial advice; not to mention that your strength in context clues are that of a two year old.

    you cannot file BK until you have established residency. You stated you MUST have a vehicle immediately. You said you did not want to pay an exorbitant interest rate. You are the one that spoke of "filing first". You figure it out.

    I simply am amazed at your attitude. You admittedly have horrible credit yet you somehow think you will be graced with gifts of gold because you made some regular payments on a car, well before your credit went into the crapper. You seem to think "overdrafts on numerous checking accounts" are simply wiped away because you left the country. You believe that good acts in the past will overcome your more recent bad acts. I am simply amazed.
