My question involves criminal law for the state of: Arizona
I was recently arrested without going to jail for shoplifting at a local K-Mart store. They printed up a receipt with the total adding up to $75 worth of merchandise. I say "they", I am referring to the LOSS team at K-Mart. I never resisted, was very up front and honest about what I took, and compliant in every possible way. The police officers showed up and read me the Miranda, searched me and interviewed me. Again, I was compliant, quiet, and epitomized the term humble. They issued me a citation for shoplifting and escorted me off property. I am a student who just finished my Associates in Applied Science and have recently applied for the Nursing Program to become a Registered Nurse. I did not NEED these petty trinkets that I swiped from K-Mart. I was actually shopping when I came across these items already open and lying in a vacated shopping cart. Of course I thought I was real slick at first, but for an instant, there was a voice in my head that said "Do Not". I ignored it and am now paying the price. My questions are as follows:
- Will this go on my record as a criminal arrest?
- Being my first offense ever with the justice system, will I go to jail or is there a chance of participating in a "diversion" program?
- Before I go to my court hearing, would it be wise to complete an "Offenders Solution" adult theft/shoplifting class providing me with a certificate upon graduation? Write an apology letter to the "victim" and to all other parties involved due to my arrogant, irresponsible incompetence?
- What would you do if in my position right now?
