    Question What Do I Do if Someone Served Me with a PPO That Was Not Real

    My question involves restraining orders in the State of: Michigan

    My Fiance and I were both served with PPO's the other day. After taking the following day off of work, filling out the response and termination, we went to the court to file and the cleark informed us that the PPO had been denied and the person was told that the day he/she requested it. Is there any legal action that can be taken?

    No, there isn't any more legal action that can be taken against you under that denied PPO. Once it's denied, that PPO carries no legal weight. Feel free to go on with your life.

    The only thing that the other party can do is try and get a new PPO approved.

    To parse words briefly, there isn't any additional action that could be taken against you, as the petition was denied. You might be able to make a complaint to the city or county attorney regarding the alleged service if you have enough evidence that would support a complaint. Michigan (as do many other states) has a criminal statute that prohibits the "simulation of legal process". That means that a person (authorized or otherwise) cannot serve documents that are formatted to appear to be from a court or any other documents under false pretenses.
