    Default What Compensation Can the Victim Get for Battery and Intimidation

    My question involves criminal law for the state of: MA

    On July 3rd my mother let a man, who she met online 4 days prior, drive her truck. The man was driving erratically and pulling into strange dead end places, I was in the car following behind my family who the man was driving, and when he pulled over I took the oppertunity to run over to my mother's truck. I opened the door because I feared for my younger sister and brother's saftey. My younger symblings sprang from the truck with panic and releif and were very clearly terrified by the man. He is a 36 year old ex-boxer, over 6 feet tall, and fairly wel built. He then got out of the turck and began to take his shirt off to fight me, a 21 year old, 5'6" 125 pound girl. A few feet away my boyfriend is getting out of the backseat of the car I was riding in to try to get me away from the increasingly aggressive shirtless man who is now screaming and threatening me and my friends who hadn't exited the car or spoken to him. By this time the children had run to the car we came in for safety. The man begins to charge screaming that he is going to kill all of us. He throws me twice picking me up off of the ground and throwing me several feet across the rocky dirt. My glasses go flying and I can no longer see. He jumps several feet onto the hood of my friends car and begins to punch it. He cracks the windshield and dents the hood. He also reashes into the car and starts to try to pull the friend in the passanger seat out by the neck through the back seat that my boyfriend had left open. THe man fled with my mother and her truck shortly after, a few minutes before the police arrive. We filed some assault charges and one for property damages, but I don't feel satisfied for what he did to us.

    I am covered in bruises, road rash, scratches, and it hurts to move. I tried to go to work today, 2 days after the attack, and was sent home because I was not fit to work. I have not gone to the hospital, but have been considering it. I don't think I have any magior injuries, but I would like to get some sort of compensation for all the pain that I am feeling, the terror and trauma not only inflicted on myself and my fiends, but my uneraged brother and sister. He hurt me, threatened all of our lives, and chased us down with the intent to kill us all, if there hadn't been a hidden house behind some trees where the people called the police he would have killed us. He was talking about all of the guns he owns prior to the attack.

    Is there anything more we can do to make sure this man is punnished? Can we sue him for pain, suffering, and trauma? Or for anything else? I want this man to pay.

    You would be able to sue him for your expenses/damages.


    as to anything else; nothing I can think of.


    This whole thing seems to be missing information. Why were you following your the guy? What has happened with your mother? Why would he attack you?

    He was driving my family in my mother's truck, we were following him as we were going somewhere together to see fireworks, with my family. He was my mother's almost boyfriend and he drove her and her truck home, took his car that was at my mother's place and left.

    He seemed under the influence of some sort of drug. He was acting very odd while we were at my mother's place, and when I got my brother and sister out of my mother's truck that he was driving, he snapped. All I had said was I didn't want him driving my family and he got out of the truck to confront just me, and I am a fairly small girl.

    He chased us down on foot screaming how he was going to kill us, we are dead, after he took his shirt off and got out of the truck to confront me. There was a house behind us that was blocked by trees and bushes none of us saw at first, and if it hadn't been for that house he would have continued to charge after us and attack us. As when he saw the house he turned his attention back to my friends car for a moment, and then left with the truck and my mother.

    Driving wrecklessky and under the influence of drugs, with underaged children in the vehicle.
    He had an intent to kill us.
    He picked up and slammed a small girl, twice, causing several injuries.
    Punched and broke a windsheild.
    Dented up the hood of a car.
    Grabbed a man by the throat.
    Threatened to kill most of the victims seperatly.
    Traumatized 2 underaged kids.
    Fled the crime scene, after we annouced we called the cops.

    ok, you experienced a whacko. That in itself is not generally actionable beyond the actual damages caused.



    so, what was your mother doing during the attack? Why did she allow him to get back into her truck? Why would she continue on with him? That seems crazier than what he did.

    does your mother still have contact with him? has he been arrested? and the charges are?
