    Thumbs up Publishing Information About a Bad Investment

    My question involves defamation in the state of: California

    Hello- in November of 2010 a friend of mine presented me with an opportunity to invest in a Legal Marijuana farm here in California. I wrote him 3-checks for $15,000 made payable to him for the investment. I never received a subscription agreement, use of proceeds, LLC document or anything outlining the risks associated with the investment as he told me I didn't need it. He promised outlandish returns and a quick turn time. Three months ago he told me that the Legal Farm got shut down and everyone lost money including himself but he will not give me any information, other partner names or phone numbers or case numbers involving the shut down. He told me he was good for the money-Now its almost 2-years later I am trying to get it back - I have noticed him with several demand letters and he has acknowledged that the investment went bad (in letter format) and it was beyond his control and has offered me much less than I lost- I believe that he took the money and made up the actual investment scheme as I have seen no proof. My questions is that I have put together a series of documents- (cashed checks, emails, letters, pictures etc.) so can I use that information to try to leverage him to get my money back-Example- If you do not give me a cashier's check for $15,000 by August 1, 2012 I will be doing the following:

    1. Contacting the SEC, FTC, Attorney General, Department of Corporations with complaints
    2. Opening a case on Ripoffreport.com, complaints.com, scam.com
    3. Contacting your business associates with information regarding the investment to make sure no one else invested or gets hurt

    And if I do use the information (cashed checks, pictures, emails etc.) or proof, can he sue me for slander or can I get hurt in any way if its the truth? His attorney contacted me and said I have no case and he can sue me for extortion but I have all the proof he stole my money! Can I leverage him and can I post the truth to keep other people from getting swindled? What is the limit to my posting?- Can I SEO and post my small claims case information including checks and letters with his name so when someone google's him the derog info comes up?

    You sat on your hands for two years? You wanted to be absolutely sure that every other creditor who exercised even slight diligence got into line before you?

    If you want to try to get money back from this guy, I think the head games are a waste of time. Consult a lawyer about suing him.
