    Thank you. I didn't realize I had been so unclear. And the biggest thing seems the use of the term adoption. I will obviously do whatever works to get me anything.

    The unclear part was where you went from saying you were going to adopt with the consent of both parents, to mom's not consenting to your having custody, to your ultimate explanation that the idea is to replace dad with you while keeping mom's rights intact.

    He referred to her as ex-girlfriend, which I imagine makes his case dang near impossible although I'll let the more learned folks pontificate on that.

    Agreed.

    De facto standing would not apply since Mom is obviously not unfit (generally a requirement in Indiana) and OP doesn't meet the parameters anyway. Recent case law out of Indiana also pretty much shot down the concept of thirty party visitation unless it involved a grandparent or stepparent, and OP was neither (see Kitchen vs. Kitchen and this ) .

    So custody aside (because OP is not getting any form of enforceable custody), he'll only get visitation by Mom's good graces.
