    Default GPS Speed Limit Higher Than Signs

    My question involves a traffic ticket from the state of: New York

    This is my first traffic violation. I was radar trapped by an officer going 46 on a 30 mph zone. I was driving on highway 36 at night, which is a highway then turns into a town road at certain points. The highway I was traveling on was a 55mph zone, which turned into a 30mph zone. The speed limit on my gps did say the speed limit was 55 at my exact point. The officer also reduced the ticket to a 1110A - disobeyed traffic control device.

    Is there some sort of way I can fight this effectively?

    do you mean based on the errant information provided by your GPS?

    No, not a chance. They post signs for you. Depend on those, not some device that holds no weight in the courts.

    and clocking you with a radar is not being "trapped".

    Not only that, but in most states it is actually defined in the law where the speed limit begins and ends for each section of road in city, county, or state code. Some treat it differently, some post it in the wrong place simply out of convenience/cost. I beat a ticket over this very thing in Washignton. I asked the officer, "Where exactly did I speed up to 40, Sir? Before or after the speed limit sign?" He replied, "Just before." I asked, "In the middle of the intersection, just before the sign, Sir?" He replied, "Yes." I turned to the judge and said, "I move for dismissal, your Honor. The officer has proven that the state has no case." The judge looked at me inquisitively, and I produced Redmond city code stating where the speed limit changes --- 400 feet prior to the sign, under a bridge. Dismissed. Both the prosecutor and cop were red in the face. It was awesome.

    You folks out west get some really special treatment. Try that around here and everybody would start laughing followed by: guilty, pay the clerk.

    If questioned, the judge would likely say: can't you read boy? The sign said XXmph. You follow what them signs say.

    LOL, Speedy, that's pretty funny. If you had smacked me like that in court, I would have been pissed too...not at you, but at the road maintenance guys that "set me up!" You can bet it wouldn't happen to me twice.
