    Default Sexual Predator Child Visitation and Support

    My sons father has been in prison for 9 years for sexual offense on a minor child. He is due to be released with a few months, I was informed by the state that he will be classified as a Sexual Predator and that he will not be allowed to see my son or any children for that matter. My question is more so about child support. I have never received any help at all from my sons father nor do I receive help from the state of Florida either. I am afraid if I push child support when his father is released that will open a door for visitation with my child. I am afraid for my child due to he is the same age now as the child his father molested. If I proceed with getting child support from my sons father will he then be able to have visitation even though he is classified as a sexual predator?

    If his conditions are that he cannot see your son, then he cannot see your son.

    IF he files for visitation (and sadly that's often triggered by the CP filing for child support), you can request that it is supervised, or you can hire an attorney and fight for no visitation. This is one of the few occasions where no visitation is possible, and perhaps even appropriate.

    Please talk to a local attorney - all things being equal, you should be able to at least file for child support and not have to worry about visitation.

    dont file for support it was the worst decision of my life.. my kids father's sudden reappearence after 15 years then subsequent disappearence again caused more of an upheavel than it was worth.

    Did your situation involve a child sex offender?

    no mine did not but my childs paternal uncle raped the stepdaughter of my childs father who was the same age as my child. All I am saying is if you can do without the money or you can sacrifice enough where you dont risk opening the floodgates for the other parent to cause any type of havoc ( i.e emotional , physical) then do it.I have seen in this forum many people posting that as soon as the child support was filed missing parents all of a sudden wanted - something. Even though they did not care about the child until then. The OP may be safe as far as no contact but there was a case I believe in either California or New York where the sex offender was indeed granted visitation because the victim "wasn't their child" so it didn't matter to the judge that he raped a little kid.. I firmly agree both parents have the responsibility of supporting their child irregardless visitation or no or if they have been missing for 10+ years but in the legal system child support gives the payee leverage to do whatever they feel even if they don't win. They can still haul you in into court for whatever they want because "they pay". So dont file or live with the consequences - your choice.

    this link had a few quick blurbs about the cases - the one I remember was in Albany.. People can agree with allowing the visitation or they don't to each his own so OP your choice.
