    Default Involved in an Accident, Not at Fault but Insurance Had Lapsed

    My question involves a traffic accident in the State of: Michigan
    I was involved in an accident today. Fortunately, no injuries. The other driver was issued a tickect for failing to yield the right of way (she pulled out of a parking lot directly into my path). Both cars were severly damaged, mine was not driveable. Checking with my carrier, I find my policy has lasped. What are my options?

    Under Michigan law, if the other driver was properly insured the most you can recover for vehicle damage caused by a collision is your uninsured loss up to $500. Assuming they were in fact insured, you can make a claim with the at-fault driver's insurance company and seek the $500; that's usually much faster and easier than small claims court.
