How to Dispute a Speeding and Insurance Ticket

An officer just gave me a ticket because he says i was speeding. I know i wasnt so i want to do a trial by written declaration. At the time my insurance paper wasnt with me but i have insurance. The ticket now came to around a thousand dollars. I want to dispute it but is there any way to do so without paying the full bail amount? Can i show my papers to them to drop those charges and dispute the speeding ticket?

What code section numbers were you cited for?

And how fast were you going, how fast did the officer say you were going and how fast does the citation indicate you were going?

It is a simple question and its already pretyped; it can be answered by simply typing 2 letters, and they find it easier to delete!!!

You don't get to see the radar gun even if you wanted to, simply because its not for you to decide if the officer is lying or not! And if he was driving behind you, then there is a high likelihood that he paced you and did not use a radar gun to begin with. Then again, I've had my radar detector go nuts when all of a sudden I would realize its that CHiPper on an M/C... I guess they now have them on motorcycles and can use them in moving mode there as well.

To answer your question, you can present the court clerk with proof of insurance showing you had a valid policy for the time you were cited and that should knock off approximately $880 off of the total amount. Still, to contest the speeding violation you will certainly have to post bail in the amount equal to that fine amount which is approximately $234 or so!

Back to the speeding citation, does the Radar box have anything written in it? If not, meaning he probably paced you, then you're likely screwed and have no defense at all. If it has any numbers/codes/markings, then you need to tell us what those are and we might come up with something!

If you are paying the fine and seeking to have the insurance violation signed off as correctable, then how are you going to have a trial by declaration? Or, is what you are saying is that you are depositing the bail prior to challenging the citations?

I believe most courts require payment up front, but if you do not know for certain either read the notices or citations you have received, or contact the court. If you walk in and sign something then give them a check, you may later find that you pled guilty.
