    Default I Want to Cancel a Stalking Order but Was Told It is Permanent

    My question involves restraining orders in the State of: Oregon

    I have a stalking order of protection against someone and want to drop it. I called the courts and they said it is permanent and that I would need to hire an attorney to go to court. If I am the one who asked for this protection , why can't I just request it be canceled now ? It is has been in effect for 10 yrs .

    Because you made a case that you NEEDED an order of protection.

    I DID need it at that time but I now live in another town 600 miles away and it's been 10 years.

    A petition form can be found here; but I would expect the court to schedule a hearing at which you (as petitioner) would be expected to attend.

    Why do you feel the need to do anything? If the restrained party wants to move to modify the order he can file a petition himself, and you would have the right to file a pleading supporting his petition without having to worry about attending a court hearing.

    I just think this order keeps me tied to this person.
    I appreciate your help on this and will decide what to do about petitioning the courts, I don't want to appear in court if the person is there .
