Threatened With Termination Over Leave for Short Term Medical Problem (Gall Stones)

My question involves labor and employment law for the state of: Seattle Washington

I have been working for ABM Security Services in Seattle Washington since the end of April. I found I have Gall Stones last week the hard way and when I told ABM HR about this they stated that if I go through the surgery for this I will be terminated. Do I have any legal rights in this matter.

basically, no.

For FMLA to apply, among other things, you have to have worked for the employer for 12 months and worked at lease 1750 hours (for them) in the previous 12 months.

Washington has their own version of FMLA (the Washington Family Leave Act) but the employment requirements are the same so to wouldn't apply either.

It's 1,250 hours, not 1,750, but since you've only worked there since April jk is correct that FMLA does not apply. And outside of FMLA, the employer has no legal obligation to allow you to take leave, even medical leave.

Well that really doens't sound good! Don't know what to do now that's for sure. LOL! Guess i'm going to hold off on the surgery for now.
I hope I can come up with a better plan for this.

Are you in the city of Seattle proper? Apparently there is a Seattle-specific municipal law that might help you. It took me till now to realize that this was the post he had left me the message about.

Well the company and my Doctor both aggreed on letting me have 7 days off with out pay and 20 days of limited duty. I just hope I have no complications.
