Reentry after deportation

I am Jamaican born and was granted alien status through filing from my mother. However, I was convicted in 1995 of a drug charge. Upon my release date I was picked up by I.N.S and deportation proceedings began. Shortly there after I was granted bail and released on a $500 bond due to hardship. by April 1998 less than a year after my release my appeal was denied. I continued to fight for my stay in the U.S. reason being that I am married and have U.S born children as well as the fact that my mother gained her citizenship before I turned 18 yrs old. on the night of September 24, 2003 I was drogged and forced to sign to be deported. I awakened in a country I knew nothing about. Noone was notified before leaving eventhough I was being represented by an attorney. Is there anyway I can return to my children? It's been three years since I've seen them! And it's becoming more and more difficult to deal with mentally! What went wrong? And how can I reenter the U.S? Please help me!

You've been in touch with your lawyer since your deportation, haven't you? You should of course follow your lawyer's advice.

yes, i have been in touch with my then lawyer. i was told by the lawyer that she could not represent me because i was no longer in the U.S. she also stated that if i could "find my way back" i had a good chance of wining my case. also that i can sue the i.n.s for illegal deportation due to the fact that i was drugged as well as the fact that the i.n.s could not show/find the document they claimed i signed. i must say that i have thought about this over and over but i am affriad of going back to jail. mentally i just dont think i could handle that. one other question, do i count from the date the deportation was ordered or from the date it actually took place????? thank you.

Count what - your period of exclusion? What is your period of exclusion?

the order was made in 1998 but did not take place until 2003. on the paper work given to me upon my arrival by the officers traveling with me, does not stipulate a pereiod of exclusion. i was also told by the officer that i can try right away. i did not take that seriously due to the fact of the way in which things took place. you know, being drugged and forced to sign something i otherwise would not have.

hello again, it's been awhile since we talked. however, i have some good news, just last week there was an article stating that a person cannot be deported if they are in the u.s legally with a green card. now the problem is trying to get back that status and returning to the u.s. do you have any advice or can you recommend a good lawyer. i miss my children and i want to go home, this place is no home for me. i am like a fish out of water.thanks in advance.

Hello,

1. Just because you are not in the U.S. does not preclude an immigration lawyer to represent you.

2. Green Card holders can be deported if they commit certain crimes - don't read questionable articles.

3. You may have certain relief/waiver, etc. but one needs to analyze your conviction/possibly illegal removal/due process violations, etc. Your drug case has also to be analyzed in light of the recent Lopez case from the Supreme Court.
