My question involves landlord-tenant law in the State of: WI
Here's the story:
Me and 3 other guys signed a lease in August of 2011.
Me and another guy (we'll call him Steve) have made up to date payments of $325.00/mo.
The other two guys (we'll call them Evan and Mark) are WAY behind. In fact, Mark hasn't made a single monthly payment since we've moved in. Evan is 6 months behind.
Landlord claims to have written letters informing us, unfortunately we never got them. He also hasn't bothered to call us or e-mail us.
Steve and I tried talking to Evan and Mark, and also unfortunately, Evan has had some really bad luck with money issues (medical bills, etc), and Mark simply just doesn't care (he's literally useless).
So Steve and I called our landlord and we came up with a verbal agreement that if we continued to make our monthly payments throughout the lease, that our landlord wouldn't sue us and make us liable for the remaining balance (even though all 4 of us signed the lease). He also promised that Steve and I would receive our $450 security deposit back.
We decided the best thing to do is write up a formal document.
Problem is, our landlord wants all 4 of us to sign it. Also, I want to get it notarized.
1 - I'm unsure if I can get Evan and Mark to sign (probably Evan, not sure about Mark) and 2 - I doubt I would be able to get all 5 of us at the same bank, at the same time to get it notarized.
Does anyone have other suggestions to go about this, or is this my best option? It would be difficult, but I'm confident in my ability to pull it off.
Also, I've written up the document as follows:
"This document acknowledges the formal agreement between landlord, -----name------, and tenants, Joshua Lynch, -----name------, -----name------, and -----name------, that Joshua Lynch and -----name------ are not responsible for the remaining balance on the lease for -----address------ signed in August __, 2011 in the county of Winnebago. This document will be nullified if Joshua Lynch and -----name------ fail to complete their $325.00 monthly payments in the months of July and August. Joshua Lynch and -----name------ will also be granted their security deposit of $450.00 so long as there have been no damages made to the residence pertaining to the lease."
Could anyone cover up any loopholes for me?
