    Default Marriage Before Citizenship Interview

My fiancee (Italian) and I would like to get married in the summer. He is in the U.S now but will go back for 3 months in August. I filed for citizenship in April, went for biometrics in May. all clean, so hoping I will go for interview Sept/Oct. Ideally we would like to get married next month (July) but not file for his status until after I become a citizen. Do you think its ok? If so, I would assume I would have to notify at my citizenship interview that I recently got married. Does that look "bad" to them?

Or do you think its best if we got married until after I got my citizenship??

My fiancee comes in with a B1/B2 tourist visa/I-94 form. Since When he comes back to U.S and we file for his 485; I-131 he still will not have interview/green card within the time frame of the I-94 limit (5-6 months) Can we or should we file for an extension to the I-94? Will staying here after the date stamped on I-94 be considered illegal even if he will be in "process of waiting for status"?

    Thanks in advance!

Default Re: Marriage Before Citizenship Interview

If you marry and he reenters on a tourist visa with the intent of petitioning for permanent residency, he is at risk of being deemed to have committed fraud while entering the U.S.

If after you naturalize your spouse is out of the country and you want to bring him in as an immigrant, the proper procedure is to seek a spouse visa.

Is there a reason you don't want to follow proper procedures?
