    Default Contractor Mistake Resulted in Delayed Start Date

    My question involves court procedures for the state of: MN

    Good Morning!

    I really wish I could let this go but I cannot! Approx two months ago & set up an appointment with a reputable driveway sealing company to seal my driveway before my sons graduation party (early June). The appoint was set up for May 24th, it rained so obviously they were not able to complete --I never rec'd a reschedule call. I called them the morning of the 25th to reschedule for Saturday, May 26th-another rain day! They contacted me & rescheduled for Wednesday AM May 30th. I called them approx 10am on the 30th to get an approx time, I was told I was told it would be before lunch. At approx 3pm still not there--called again & was told they were running behind & they will be working late & I would get my driveway sealed -nothing that night! Called-no answer. I woke up early Thursday, May 31st & called again--she said now I was 4th on the list & they should be there sometime after lunch. So it is now 2pm called-no answer, 3pm called no answer (and so on). My last call was approx 5pm & I was MAD! I told them if I didn't get a call back/driveway done I would pursue any/all options that are available to me. At 6:42 I rec'd a voicemail from them stating they were just leaving city X & would be at my house in approx 1 hours. He apologized for the mess ups & "promised" they would be there that evening & even mentioned my son's upcoming grad party (now in 2 days). Again they did not show--I called-no answer! I called the next day- no answer. My stress level was thru the roof, my driveway is/was in awful shape, & as petty as it sounds I let it ruin the days up to my sons grad party. I have phone records & the voicemail that was left. What are my options? I want them to make sure they pay for their error, my stress, etc....Any suggestions would be appreciated. Thank you!

    Other than rescinding any "contract" (which you appear not to have anyhow), you are legally entitled to nothing. While their customer relations may not be the best, weather delays like this are to be expected with this sort of business. You can certainly ask for some level of accommodation (expedience, perhaps a discount) but you are legally entitled to NOTHING. You're "stress" is not actionable.
