    Default Guardianship and Social Security Benefits

    My question involves guardianship in the State of: Mississippi

    My sister is 16 years old. She still receives Social Security benefits from our deceased father. She wants to live with me and go to school in my hometown. My mother and I have reached a tentative agreement in which I would become guardian of my sister in order to meet the requirements set forth by the school district. My primary concern isn't the money, its my sister. However, my mother is concerned that if she signs over guardianship to myself, the money stops coming. What usually occurs in a situation like this one? Would the money necessarily stop?

    So... you're stating that dear ol' mom wants to spend her daughter's survival benefits on herself, rather than having them go for the support of her daughter? And she intends to lie to the Social Security Administration, and wants you to keep quiet, so that she can keep getting the money even though you're supporting the minor?

    I suppose that's an accurate description, though it was certainly never expressly stated with the malice or conspiratorial overtones that you used in your post. Is this seriously the only post or comment to my question? I'm scrolling back to the top to make sure I am on a legal forum. Is this just a place where people come to entertain themselves with the misfortunes of others? I've read several posts here on this forum that offer very little legal advice and are more concerned with the "juicy" details of the situation. Is there anybody that knows anything about Mississippi laws regarding my topic?

    Transfer of guardianship will not stop the survivor benefits. They should, however, transfer to her new guardian (you).
