My question involves unemployment benefits for the state of: Indiana
I was terminated in mid May. When i filled out my unemployment I put down policy violation because that was there reasoning, although I do not agree. I was the only female on my shift and there was a gentalemen that had harassed me from the day I started. He would take my forklift and Hide it he would unplug my battery as I was driving threw the plant (which made me lose control on my fork lift. ) He would page me to machines that weren't running, He would throw hard objects at me while i was on my forklift trying to do my job. I went to the supervisor numerous of times and all the supervisor would tell him was to quit the horse play which he didn't. Finally one night I went out on break. When I sat down I accidently touched his shin with my shoe, and it broke his cigarette. He took his lighter and burned my coke cup. He picked up my phone off the table and was going to smash it he took both my shoes and threw them in the parking lot. I asked him to go get them and he continued to cuss me. He got up and went and stood by my shoes and i continued to ask him to get my shoes and he refused. I picked up some small pebbles like the size of a small pea and was tossing them at him saying go get my shoes please. NONE OF THE PEBBLES CAME CLOSE TO TOUCHING HIM! He came running at me grabbed my arm and twisted it behind my back and drug me by my arm around the parking lot. A guy that was out on break made him let go of me. I went in side after that and sent a email to my boss and HR just to let them know what was going on. The 3rd shift supervisor came in and asked my what happend I told him what I wrote in here and He said that the other employee was in the wrong and told me not to worry about it. I had the 3 guys that were also on break write witness statements just to make sure that HR could see there side too. There statements were dead on with mine. I got called into the office that morning and they suspended me for 3 days cause they said they had to do a investigation. The called me monday and asked if i could come in for a meeting. When I got there we set down and they told me they were terminating me for policy violation. They gave me a paper that stated why they terminated me. I refused to sign it because nothing on it was what happend. I asked them if they even read my statement or the three witness? Because they had it all wrong. I then asked them if they could put me on probation so I could keep my job. They told me no that wasn't a option. What I am wondering is there any possiblility of me getting my unemployment. All it says on my unemployment page is waiting on policy violation? Any thoughts on this would be great. What really bothers me is they didn't even try to provide me with a harrasment free work place. Even after i told the supervisor numerous time he wouldn't leave me alone.
