    Default Small Estate With an Unsigned Will

    My question involves estate proceedings in the state of: California.
    My mother passed away in May and she had a will but it was not signed. She had very little money, owned her car and mobile home out right. We are preparing the affidavit but do not know who to file it with. Do we ask to transfer the property in to my name? I am assuming the DMV and the mobile home section of the State. Also, we loaned her the money to buy the home. Not sure if that matters but wanted to mention it. Thanks so much!

    Read this.

    If you are dealing with an intestate estate, property passes pursuant to the laws of intestate succession.

    I don't know what, if any, evidence you have of the loan or whether you would be able to successfully assert it as a claim against the estate. If you're the only heir, it all comes out in the wash.
