    Default Fair Use on TV Clips for Documentary

    Quick question on interpretation of fair use....

    I am working on a documentary about Cajuns and the oil industry. I would like to introduce the section of the film about who Cajuns really are by first presenting the stereotypes of Cajuns that are portrayed in the media and then discrediting them as dishonest portrayals. To do this, I would like to use brief clips from the reality tv show "Swamp People" and clips from an old cooking show with Justin Wilson. Could use of said clips be considered fair use being that I am critiquing these program's portrayal of Cajuns as back-woods hillbillies?

    fair use is decided on a case by case basis by a court. It's not whether you or I believe it is or isn't fair use but rather if the owner of the rights accepts it as fair use and refuses to take any action.


    Unless you are willing to defend a claim of copyright infringement, even if you are correct, you would be best served by obtaining permission first.
