    Question Peremptory Challenge in Small Claims Court

    My question involves small claims court in the state of: CA

    I had a hearing in a small claims court. Well, it actually was not a real hearing. It started and the commissioner was on the mission to save all defendants in her courtroom. I am the plaintiff. She found problems in everyone plaintiff's case and when my turn came, the same thing happened. She continued my case and told me to split my case into two parts. I have postponed the continued hearing and requested the change to the different department. It was done as I requested. The defendant now requested to postpone this hearing and requested the same commissioner that I changed from. I filed today the peremptory challenge. What can I expect?

    What facts did you describe in your written, verified statement to support your claim that the small claims commissioner is prejudiced against you?

    Why do you believe it was an error to split your case into two parts - what are the relevant facts there, and is that part of what you're alleging to be bias?
