    Default Can You Get Emancipated if Your Parents Won't Change Custody

    My question involves juvenile law in the State of: Indiana

    I really hope somebody will get back to me,and soon...god,where to begin..my whole life my mom has been an alcoholic but she quit about a year ago.as long as i can remeber,shes been violent and abusive.she still is even though shes sober...shes thrown me down the stairs,chocked me,smacked me,thrown cigarettes at me....thats the physical..ad emotional?i have probabyly the lowest self steem of anyone i know.as long as i can remeber shes told me im stupid, ugly,worthless,a bitch,a whore....i got into some trouble last summer...sneaking out:/ i hope that doesnt hurt my chances of getting outta here...im 14,can i get a custody change to my bestfriends?her mom is totally chilll with it.im gettting a moped and a job as soon as im 15.then can i file for emancipation?thanks..

    In order to be emancipated in Indiana, you need to be able to prove to the court that you are able to single-handedly support yourself. That does NOT mean living with someone else; it means that you are paying 100% of your own rent, food, utilities, clothing, medical care, transportation, insurance, school fees and supplies, staples, etc., etc., etc. Where are you working and how much are you earning that you are able to do that?

    I didn't think so.

    If your mother gives you permission to live with your best friend, then you may. If your mother does not give you permission, then you may not. It really is that simple.

    Of course, if you are being abused, you need to pick up the phone and call CPS. They will not emancipate you, but if they find that there is a valid reason to take you out of the home, they will do so and place you in foster care, a group home, or with other relatives.
