    Default Computer Voice Summons

    My question involves collection proceedings in the State of: california

    a computer called me to notify me that i would be served a summons at my place of employment or residence.

    is this not a threat? is this not a violation of collections laws? can they really just call a phone and say that?

    can i sue them?

    should i sue them?

    what is SOL on this violation?

    saved it on voice mail!!!

    If you are called and informed that you will be served with a complaint and summons, and that in fact happened, it's simply a statement of what's going to happen.

    A debt collector cannot lawfully threaten to sue unless they actually intend to do so, and cannot lawfully inform you that you will be served with a summons if in fact no suit has been filed.

    What is the detail here - were they cautioning you that if you try to dodge service at home they'll try to serve you at work?
