My question involves collection proceedings in the State of: Illinois.
Hello,
My partner requested a trial in April, 2012 disputing charges the attorney for Cap1 is insisting is owed. She just had her credit card trial yesterday. She was not disputing the debt because she did own her card but the charges were off the charts and had paperwork to prove.
The lawyer for Cap1 looked into it and offered to lower the 2,300 due to 1,000 ( The figured we came up with our records) and settle before seeing a judge. Being she did own the card and we came down to an offer we felt was the range expected... she agreed.
However, Looking at the case and what was entered on the county court website, it states that " A confessed Judgment is entered against Def for $1,000.00. See Order. ORDER''
Thats all. Only thing I am confused about is the confessed part. I would expect to see '' Settlement Agreement''. Anyways, What is the difference?
I have never seen it worded this way. The attorney did not set her up on a payment plan, just said if she works they will garnish if over the state limit. And.or assest like a bank account will be taken.
We live in Illinois.
Thank You!
