    Default Emancipation of a 17 Year Old in North Carolina

    My question involves court procedures for the state of: North Carolina.

    Okay. I'm a 17 year old girl in North Carolina. I am filing for emancipation. I live in a very emotionally abusive home. My mother threatens me, but never hits me. My step father is very violent. he has threatened to kill my mother several times, he's held a gun to her head in front of me 5 times. I am currently not staying with them. I'm in another county. A few nights ago when I was staying with them, I came home about 10:30, my step father comes outside, IN HIS UNDERWEAR, intoxicated, and shoots a gun at my boyfriend's parents truck, must I add for no reason. My boyfriend's parents called the cops, and they said there was nothing they could do. I told them I didn't want to live there anymore and that I was tired of living there in a household where I don't feel safe. They told my boyfriend's parents that leagally I could leave my house and nothing bad would happen. They told me I had to go back to my mom. They told my mother that she could get me sent to juvi if I left. She only wants me at her house to get my social security check from where my father died. She's been threatening me, and talking about sending me to a group home. I left Sunday night about 11. I am now residing in another county. I called and filed for emancipation on Monday. They're in the process of doing my paperwork. I am currently waiting for the email so I can print it out and take it to the courthouse. My legal aid assistant told me I won't have court. I have a house already ready for me to rent, I've talked to the owner, I'm in the process of getting my job transferred to that county. I have my GED, and I start college in August. I'm also in the process of getting my license. I've been in a mental hospital three times due to my mother's constant emotional abuse. I am going to print out the documents to show the the people who review my paperwork. Basically my question is, what is the likelyhood of me getting my emancipation request granted? Also, how long is this process going to take? I know my mother isn't going to consent to me getting emancipated. But I read that if there is any form of abuse then I don't need her consent. Thank you greatly.

    Basically my question is, what is the likelyhood of me getting my emancipation request granted?
    How long have you been supporting yourself 100%, with no help from anyone?

    He should have been arrested for illegally discharging a firearm. The police should have also checked to see if he has a felony conviction or a domestic abuse conviction which would prevent owership of a firearm. The police should have checked to see if it was obtained legally. He could have been arrested for attempted murder if it hit the vehicle. Some lazy cops apparently.

    We get the emancipation question on a regular basis, and the answer is, virtually not a chance.

    However, for this and other obvious reasons you should keep a diary to record all the stuff your disfunctional parents do. Keep it separate from any diary with your personal stuff, assuming you keep a diary. Document anything you can with photos or video. Don't risk your safety though to do that. Keep everything off your parents property.
