    Default Summoned to Be a Witness

    My question involves court procedures for the state of: Hungary/Spain

    Hi,
    I work within the vacation industry in Spain. The other day one of our departments received a fax asking me to attend a court case in Hungary as a vitness in a few days from now.
    I was not served the summon (subpoenas) personally, never signed anything.
    As I have not been served properly, should I ignore the whole matter till i have been served in a proper way?

    Nobody here knows EU law, much less with that sort of detail.

    However, certain basic things. If it is related to your employment, your employer should have an attorney that can be asked the legal significance of the fax. Is a fax proper service? I doubt it. Is there some EU legal rule or treaty that requires your attendance? I suspect not. I read some EU law and have never heard of such a thing. I would also think that anyone issuing a subpeona to you would have to pay all of your expenses to appear. You can't be expected to use your own resources for some stranger's benefit. Never heard of a legal system like that. Generally foreign process has no significance or enforcement power.

    At least I provided some info, unlike most of you who post questions to questions, etc. or don't help. What do YOU know about EU law? How many cases have you done in court in any area of law? Name one thing that I am wrong about in any thread. You people just don't like anyone who might be more helpful or has something to share. I don't see any rule on this board that I can't make a comment on something. This thing has been a monopoly voice for a long time. You certainly didn't provde any help. How many IP cases have you done in U.S. District Court? How many patents do you hold? Have you ever even done business in a foreign country? I have spent many months in Europe and Eastern Europe setting up businesses and conducting business. So who are you to tell me I talk "tripe." Have you even been out of the country?

    Obviously if it was faxed to the employer it is about his work in some way and the employer probably has an attorney to consult. So what the heck is wrong with that advice? Much of EU law is taken from the English as is our law and there are many common principles though the details will vary.

    You certainly added NOTHING of any value to the thread by bitching at me because you have no clue about EU or national law and just ass ume I don't.

    Conrad, WE DO NOT HANDLE ANYTHING OTHER THAN US LAW HERE.

    We don't care about your patents, you still have to follow the rules. That means we don't offer even a guess at the law in other countries. We either explain that we do US Law Only, or provide a link to a place that might be able to help.
