    Default Single Vehicle Accident While Uninsured After Getting Cut Off

    My question involves insurance law for the state of: OHIO

    Well my friend was driving on the freeway during light rain. Well a boxcar cut her off she slammed the brakes to avoid hitting him but caused her car to lose control and slam into the divider. She did not have insurance and still owes allitle bit on the car. The officer came out didnt give her a ticket a truck driver saw the accident vouched for her and got the name of the boxcar who cut her off not the licenseplate he kept on going. What should she do?

    Run the car through a local salvage auction. Use the money to pay it off. Buy another car. Put insurance on that car.

    There is nothing she could do to the driver that cut her off unless she came into physical contact with that driver while cutting her off.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......

    I hafta respectfully disagree with ya on that one WTG. I don't know about most states, but in mine you can be cited for Careless & Imprudent driving resulting in a crash regardless of physical contact. You can also be cited for leaving the scene of an accident if, by witness accounts, it can be reasonably proven the offending driver was aware of a crash caused by their action(s).

    Granted, it's a tad difficult, but very chargeable.

    One question though; What is a boxcar doing on the highway? That must've been one wicked derailment!

    I see where you are coming from on that one souperdave, but you do know the driver is going to state that "they can't help it if the other person doesn't know how to control there vehicle". And there insurance company will go to bat for them. Regardless, the other party that did the cutting, can get a moving violation ticket, but they wouldn't be included in the accident report.

    The other vehicle's action(s) would most certainly be an integral part of the initial PD report. That would be the aspect that would initiate and/or warrant further investigation.

    If there's no mention of any other vehicle involvement in the report then it'd be case closed in probably a pretty rapid manner. The other vehicle aspect is pretty important. And it does not matter what the other driver claims if there's credible witness statements that show otherwise.
