I found your post which was on the 6th or 7th post.
    I referred you to post # 5.

    Wherein I stated

See if this makes a difference:

    Your appearance is: OPTIONAL
To request an Arraignment date without posting bail, you may appear in person at the Clerk's office. You may also mail the "Amount Due for a Court Appearance" and select the hearing type from the two options below to schedule a court appearance by mail.

If your appearance is mandatory, you MUST arrange a court appearance date. No other options are available to you and you are not eligible for a Trial by Declaration.
In other words, "If your appearance is mandatory, you MUST schedule a court appearance. You Have no other options and no, not even a trial by declaration! Do not pass go. Do not collect $200!

For you, however, your appearance is OPTIONAL and as such, you need not schedule a court appearance if you choose not to appear), but you also have the option of a TBD.
In other words, the sentence "No other options are available to you and you are not eligible for a Trial by Declaration" is connected to and is in referene to cases where an appearance which is mandatory where you must arrange a court appearance date and you have no other options. The top of that same paragraph clearly states that YOUR APPEARANCE IS OPTIONAL and the provisions for a mandatory court appearance do not apply to you. So you ARE eligible for a TBD.

You want me to do these step by step to filing a TBD.

Complete the basic info on a TR-205.
Print 2 copies of the form.
    Go to court.
Take both copies with you to court along with a check for the bail amount. (write "not guilty TRWD request + bail for [citation Number]" on the Memo part of the check).
Turn one in with the clerk and have him/her stamp your copy with a date stamp (It'll show the court's name, the date, the word "FILED" and the clerk's name for your county).
Now you get to wait for your TBD form in the mail (or they might complete it -write in the due date and the bail amount they received- and give it right back to you).
If you want to... Those steps are what I would do to ensure a proper and timely filing of the request by the clerk and so that I have something to fall back on (my own copy of the request that was date stamped by the clerk) if something goes awry later...

As for filing a discovery request, when should this be filed by? As soon as possible? I have already my discovery request form ready and don't know when exactly to turn it in or do with it.
Discovery requests should be served and filed ASAP... Although I am not sure what is it you're hoping to get out of discovery?
I am right 97% of the time... Who cares about the other 4%!

    Okay thanks.

For the discovery, I don't know. The cop who clocked me was wrong when he puled me over you know.

For the TBD, it can be filed at any day before the bail due date?

OK, keep dreaming that he was wrong!

Just understand that there was no requirement for him to "clock" you simply because there is no specific speed that is declared as minimum. The simple fact the you appeared to be driving at a much slower speed that traffic at the time, is reason enough to get pulled over and cited accordingly!

Yes, "ASAP" would include any date/time regardless of the due date!

Yeah I know he is wrong because when I looked at my speed meter after I noticed that he was trying to pull me over. I'll still fight this ticket even though i'll know that I will lose. I just want to see if the police officer would appear at trial and file a TBD, I got hope!

still such a bogus ticket though entering traffic going at slow speeds, bam pulled over.

The guy, what if you stopped in middle of traffic ( where people pull over in middle of free way ) and then you enter the traffic and then you get pulled over instantly by a cop and you haven't even reached the legal speed limit. You know thats a bogus ticket, am I right?

You're required to enter the freeway at the speed of traffic. Not enter at whatever speed you feel like driving for the day and then decide if you want to get in people's way or not!

Your question makes no sense at all. And you're still wrong!

You cannot under any circumstances drive at a speed that is ridiculously slower than the prevailing speed.

Regardless of how you phrase it, the answer is still the same!

Assuming the judge grants your request to go to traffic school.

my citation qualifies for traffic school and also being my first offence. i think my ticket is still bogus cos i see people around the highway going 45mph - 50 .so ridiculous

hell, my mom and dad drives 50-55 on a multi lane 65mph highway maximum speed limit and cops pass by them!

its just in my area, cops are real dicks. everyday during morning, i would always see a police officer pull over somebody for either carpool lane or crossing the HOV line or going in a car pool and theres only one person in the car.

Cops in your area are doping their job if they're citing for those violations.

And the more you post, the more stupid you sound. So may I suggest that you refrain from trying to justify your deliberate violations by shifting the blame elsewhere.

Regardless of whether this is your first or 100th violation, some judges do not allow you the traffic school option after going to trial. so the only time you are guaranteed traffic school, is BEFORE you do a tbd or go to trial. Once you've done either, the judge can deny your request for traffic school and there isn't anything you can do about it.

How exactly could I be able to request traffic school before a TBD/Trial? I thought you were granted traffic school after losing trial/tbd first or second time.
