Yes, you have expressed exactly my view on it. I'm upset and I think some serious mistakes were made, but from what I've read there's no one to really pin the fault to (though I'm not interested in placing blame anyway) and the only way to hold the county or PD responsible is if we can claim that a specific policy or procedure is at fault for the error, which is almost impossible to prove ... in addition I'm not denying that something was outstanding and needs to be taken care of or that he didn't violate his probation at that point ... but because this is a clerical error that was not handled before or when the case was closed, I'd just like him to be able to move forward without starting over with a new arrest on his record. Unfortunately we checked into expunging his records some time ago and that is not possible, that's how we found out that the records are only viewed about 7 years. In any case, yes ... I'm also aware that I don't get to plead his case and that would have to be done by him and his public defender. However, I do appreciate your help because this is valuable information that I can share with him to help him decide how he wants to proceed. Thank you so much! =)
