    Default Furniture Repo in North Carolina

    My question involves collection proceedings in the State of: NC
    The store I financed some furniture from came knocking at my door today to repo it. My wife has feld to make timely payments but was able to convince them to leave. My question is, Don't they have to carry me to civil court and get a judgement against me and can they repossess? Also if I send them smaller payments before I'm served with civil papers will this relieve me of judgement as an attempt to pay?

    I expect that when you read your contract with the furniture store, you will find that you gave them the legal authority they need to repossess your furniture based upon their "purchase money security interest" (PMSI) in the furniture, akin to how a lender on a car loan can repossess a vehicle based upon its lien (a formalized security interest). Furniture stores that finance their own sales craft their contracts to give themselves the maximum possible leverage.

    If you want to work out payments with the furniture store, you need to call them and work out the deal.

    You certainly can work out a payment plan with the furniture store, however, they're not under any obligation to do so. Your contract holds the answers, as it usually outlines the conditions in which property can be repossessed and how it will go down.

    That's correct. The fact that you want to work out payments does mean that the store will agree to accept any payment short of what is required by the contract.
