    Default Delivery of Summons

    My question involves collection proceedings in the State of: New York.My husband is being sued by Portfolio Recovery.When served with the summons he refused to take it.The lady threw it in the road and left.Is this legal.Also His name is spelled wrong on the summons.

    the misspelling isn't going to mean anything.

    the service was adequate. If all it took to deny service was to not take it in your hand, nobody would accept service and the courts would stall. The fact the server identified him and delivered it to him is adequate.
