How Can You Terminate a Child Support Order

My question involves child support in the State of: Ohio
My son is 5 months old , & child support is just messing aroung down there and I have no job, mind you in a minor with a child, no one wants to hire me , and there has been no check in almost two weeks. My son's father is getting very annoyed with this due to it's getting taken out of his check & since he stopped paying in person it's taking a longer time & not enough to buy the baby supplies I need, and wants it stopped also. He was giving me money every week before child support since our son has been born , and I feel like all we're doing is wasting money and time.. How can I terminate child support?

But i'm not getting it , so thats why his father and I have agreed to close the case. His father was giving me the money I needed for our son until Child support got put into place.

And he'd be just as stupid for allowing you to close the case.

He is, incidentally, allowed to open a case himself and you'd all be back to square one. I'm honestly not seeing what the big deal is - am I missing something?

Court orders - specially for child support! - protect EVERYONE.

Then by all means, contact child support enforcement and file to modify (stop) the current order.

But you best make sure you don't go on any form of cash assistance.

(Someone a little harsher might also say, either "Get yourself a job to support your child", or "give custody to Dad so he doesn't have to pay".

Ok if you are together why do you have a child support order? If you are together what difference does it make if it is coming out of his check or not? If your together than he should be helping you with the things his child needs. Also if its not coming out of his check then he is SUPPOSED to send in the payments to the state disbursement unit. He would send the payments in until the IDO is actually being done by his payroll. I wouldn’t stop the order in case you were to not be together in 1yr or so down the line. Then you will have to go to court and most likely have to wait more than 5 months to get a new order established and going!

It took me years to get a support order, so you are lucky to have one so quickly!

Before you decide to terminate the order spend some time reading the "child support" posts on this web site so you can see what others in similair situations have done. Then, talk to a lawyer. Most will talk to you for a few minutes at no cost.

The other parent may not be paying now but the order can be enforced so that he will pay at some point. If he lands a good paying job down the road, or a huge tax refund, then you will kick yourself for being so foolish. Both parents have an obligation to financially support the child.

Ok if you are together why do you have a child support order?

That was exactly my question. Did YOU seek this child support order, or did the government step in and seek it on your behalf? If the later, you need to realize that if you are receiving government benefits for the child, food stamps, etc. then the government will seek to collect payment for those services by assessing child support and you won't be ABLE to close the case until the taxpayers have been reimbursed for the expenses.
