    Default Accused of Lying by Pharmacy Board

    My question involves defamation in the state of: When applying for registration for Pharmacy Technician I lied on application when ask have I ever comitted a crime I said no. About 3months later the board notified me I had a felony this was around about 2004 or 2005. The public can view this information and in 2006 I was laid off and to present I haven't found full-time work. I presently work contract off and on. In 2009 I notified Board I didn' t have a felony around 2010 they finally revised the order. Last week I was trying to get a position out of town and a recruiter stated that I client was not interested because I had a felon, afterwards I revisited the revision of the order and with all there errors and statements it can cause one to believe other wise. Can I take the board on for defammation of character?

    You have a criminal history, and you lied about it. But you're quibbling about when the crime was committed?

    You falsified an (or more) application claiming you had no criminal history. Then you were 'found out' and laid off. Then you told the board you didn't have a felony and they bought it. Then your most recent attempt at employment led a reruiter to turn you down 'cause they saw the felony. Then you claim there's some sort of "error" that can cause someone to believe you actually are a felon. Then you wanna sue for defamation 'cause the accurate information (you're a convicted felon) now shows when a background check is accomplished.

    Is that what you're saying? You wanna sue for accurate information in your background check?
    You can educate dumb, but you can't fix stupid!

    Perhaps he is trying to suggest that the conviction was for a misdemeanor? It would help to have clarification.
