    Default How to Determine If You Were Cited or Charged, if Not Arrested

    My question involves criminal law for the state of: Maryland

    I got very drunk in Maryland and walked back to where I was staying. During my walk I caught the attention of the Police -- I don't remember much but they may have noticed me while I was trying to talk to some people I met on the street (there was no violence, someone may have yelled at me but nothing shady was going on). Alternatively, they may have found me later passed out on the ground somewhere, I'm not sure. At some point I puked on myself. The police did not take me "in"/ to the station, they just took me back to where I was staying. I don't remember if they gave me a citation or not and I could not find any paper work the next day. I'm concerned they may have given me one that got lost and I'm not able to search for it now.

    Questions:
    1) How do I find out whether or not a citation was issued? (I have no paperwork and don't know the officer's names). When I called the main police station an officer searched their database and told me he found nothing but indicated that its still possible a citation could be in the works within the district's office. When I called that office another officer told me that if they issued one I will receive a copy in the mail within the upcoming weeks but without officer names they can't do anything for me.
    2). I'm interested in resolving this in a way that will not show up in a background check. If I had the paperwork would an attorney be able to make use of this 2-3 week period or would he just wait until it was formally issued? I'm wondering if inaction during this time puts me at a disadvantage.
    3). I don't remember much but I'm concerned I told the cops way too much personal background information. Can that be "used against me"? I assume I wasn't arrested since I wasn't taken in and therefore presumably was not read my rights.
    4) If someone did "call in" a complaint does that make things more complicated?
    4) Give me a worst and best case scenario please. This is a first offence. I don't even have any traffic violations. Age: I'm near middle aged so will that make much of a difference for the better or worse or not at all?

    Best case: nothing! Worst case: a cite for public intoxication. Give it a couple weeks then re-run the same contacts you've already done; main P.D. station and district attorney's office. That is if you haven't received anything in the mail.

    As far as the "....told the cops way too much personal background information...." That may be a unnecessary concern. You were intoxicated and the officers most likely did not pay any attention to what you said. All ya hafta do is watch a "Cops" episode or two to see what sort of credence is given to those three-sheets-into-the-wind or worse.

    Bad thing about drinkin' yourself into a stupor and havin' a close encounter with the law....you may have the right to remain silent, but you don't have the ability! (Thanx Ron White for that true-ism)

    Next time you embark on that degree of bender you may wanna do it in the company of friends. By yourself and toasted could end up a whole lot worse than simple encounter with the local law.

    Two questions:
    1) Are you saying that in Maryland they would cite me for Public Intoxication rather than Disorderly Conduct?
    2) Is doing nothing legally until I get the citation going to put me at a disadvantage?
