    Default Fracture Misdiagnosed as a Sprain

    My question involves medical malpractice in the state ofhio. I twisted my ankle in december 2009. I only saw the E.R. doctor for about 3 minutes before going for an xray.Later a nurse came in and told me it was sprained and what to do for it. I was unemployed without insurance at the time so I wasn't able to follow up with my pcp. I did however go back to the E.r. after a week because I was still unable to walk on it. The triage nurse told me to give it time and didn't even let me see a doctor. In july 2010 i started having issues with this ankle like locking and giving way. went to a different E.R. and they said it was arthritis and to deal with it. In april 2011 i got insurance and a new pcp he sent me for an mri because the ankle was still not right. It was found that i had fractured my talas dome and there was now a cyst growing in my bone.(known as osteochandral defect.) I had surgery to drill out the cyst and clean up scar tissue in that ankle on may 22 2011.Since then i have had a cast ,a cam walker and physical therapy. things were going good till a couple months ago and now i am being sent to another specialists for possible surgery again to plug the holes with bone from my hip.(also known as oats.)Can I sue the hospital or ER doctor for the misdiagnosis? Is there anything i can do at all? For the first surgery i was out of work for a month and this one if i have it will be 6 months.

    well, now you did. When I posted, all that was there was exactly what I quoted in my response.

    has anybody looked at the initial x-ray to determine if the radiologist missed it or that it just wasn't visible?

    yes and it wasn't visible as ankle fractures don't show up right away. however, with going back a week later when i went back had they let the doctor look at me and done another xray it would have shown up i have been told.

    Even if we assume malpractice occurred, you appear to have a statute of limitations problem, so I suggest having your case reviewed by a malpractice lawyer - expeditiously.

    Told by whom, and when was the last time they had their crystal ball recalibrated?

    That's actually a very important point. Nobody can ever say for sure what would or would not appear (in this circumstance at least) a week later.
