    Exclamation Living With Grandmother, Would Prefer to Live With Father

    My question involves guardianship in the State of: Missouri to Virginia

    I have lived with my mother my whole life but I have a relationship with my father. I am now 15 years old. I will be 16 in October. My father lived in New York but has recently moved to Virginia to help out my Aunt whos been diagnosed with cancer. Me and my mom had a major fall out and she threatened to kick me out. Well she actually made me pack all of my stuff and sent me to my grandmothers house and said not to worry I wouldnt be there long and that she was going to send me to a group home. My father is aware of all of this and we have both (my father and I) decided that it would be better if I came to live with him. My mom hates my father and doesnt want me to go but I want to. They have never had a custody heiring over me so neither one have sole custody. Im not sure how that works. But what can I do to go live with my dad? I really really need help.

    You posted this as a guardianship matter, not a change of custody issue. Are you stating that your grandmother is your court-appointed legal guardian?

    No. Sorry for the confusion. But no one has custody of me. I lived with my mother my whole life. My mom took me to my grandmothers house just until she can find some place else for me to stay but I want to go live with my dad. She doesnt want me to go there. My grandmother is just letting me stay there until my mom takes me to a group home but I want to go live with my dad.

    Im just confused as to what it is that I can do to go live with my father so my mother cant stop me. Because right now she is trying to stop me from going.

    Then your Mom has custody of you by default, if there are no court orders in place. You stay where your legal guardian - Mom - says.

    If Dad wants custody, he'll have to file.

    My mom knows that I'm planning on flying to live with him and she angry but she hasn't objected in any way at all. Is there a possibility that my father could get in trouble when I get there?
