Grandparents Rights Law in New York

My question involves a child custody case from the State of: Dutchess County NY
We have always provided financially for our only grandson. My grandsons father is in a federal prision awaiting sentencing since February. Because my daughter has never acted like a mother we have taken him in with us since April and pay 150.00 for daycare.
My daughter took him this weekend and said she does not want him to visit or be around us. What rights does his father have, and what rights do we have as grandparents?

What does "my daughter has never acted like a mother" mean? The child is how old and has lived with you for how long? Is the child being properly cared for by mom, and if not what are the problems?
