    Question Aid of Execution

    My question involves judgment recovery in the State of: Florida


    I received in the mail a Aid of Execution for a judgement I didn't even know I had. It's from 12 years ago in Florida. I did a county record search and found out that a default judgement was granted. I was never served or received anything in the mail about this. I moved far out of the state 11 years ago. I want to fight this and get it taking care of, but I need a course of action.

    Will I have much luck fighting since it so old? Is an Aid of Execution for wage garnishment? I think I need a lawyer?

    First, the holder of the judgment would need to know where you live now. They would have to file it with the Clerk of Court in your county before they could try to execute it. Normally you would then be ordered to a deposition with your financial records and they would find out your bank accounts, where you are working etc. I don't think you could do anything at this point about the judgment itself, but it might be possible and that is what the attorney can figure out.

    Well they know where I live if they sent this to me. Should I ignore the Aid of Execution/Interogration questionnaire since I am out of their jurisdiction? So you think trying to get this vacated (I've been reading a lot this weekend) is not possible since it's so old? I would think I could fight it if I didn't even know about it til now.
