Child Porn Possession

My question involves criminal law for the state of: federal offense, possession of child porn.
i was coming back from afghansitan and stopped by ICE at the airport in the US. comes to find out i was on a watch list. i never, sold, uploaded, shared... iwas was in a very dark place at the time but I'm not making excuses. after paying my first attorney a pile of money he was purposely not telling me everything about my case, not telling me options that were off the table to extract even more money out of me. i went to another attorney to ask him what questions i should be asking the first attorney. i found out that i should have asked about a "motion to suppress the search" thats when the truth started to come out. i was on a watch list, most likely because i was reported by my ISP provider in my home state when he saw i was using peer to peer, like lime wire...yes I'm a dirt bag i get it, it comes from a bad child hood and a lot of self hatred, but i never hurt or directly hurt another living soul.

so now what. i don't trust any attorney, they all want $40k up frt to talk to the federal prosecutor. heres where it gets sticky. my first attorney told me i could run, go under ground in some 3rd works shit hole for 10 years and then come back with a clean slate. so, the coward that i am, i ran. since being on the run, i do know the fed knows I've fled the US. I've done research on my own can i have seen where there is no statute of limitations for possession of child porn. other web sites that lawyers chime in on have different point of views.

can someone offer any advice on this statute of limitation thing. does it matter that I'm on the run, if I'm a fugitive, which i am, do i keep this status regardless if I'm underground or not. please someone give me some advice other than "do us all a favor and eat a bullet" which is a serious option for me at this time

You are in serious trouble. You are apparently being charged for possession of child porn. You need to realize that once charged, there is no statute of limitations. Beyond that, leaving the jurisdiction of the court usually stops the running of the clock for any applicable SOL. In either case, it won't expire in your situation.


You have a couple choices:

continue to stay outside of the US and outside of any country where you could be deported back to the US for the crimes or face justice. Obviously you are entitled to an attorney. The old "if you cannot afford one, one will be appointed" applies if you cannot afford an attorney (the courts determine eligibility at the time of application).

and obviously the option you mentioned which is completely within your control. It generally isn't seen as a good option to most though.

realize the children involved were harmed. If there was no market for child porn, they wouldn't make it. Because of your actions and anybody else that seeks child porn, yes, people are harmed. While you may not have pulled the trigger, so to speak, you bought and loaded the gun for the pornographers.

anyway: if it's any consolation. A friend who has acquaintances in both federal and our state's prisons, he said federal time is much better. Don't know if that suggests less ass pounding or merely a better lube when being pounded but he said if he had a choice, he would much rather be in a federal pen than a state prison.

yeah, i get it, I'm a dirt bag, i was begging for help. I'm out of this dark place i was in and now into an even more horrid situation. downloading what is did is an awful thing, i was here for some help and i don't blame anyone for taking jabs at me. maybe i don't deserve to live, but I'm trying to save the rest of my life and try to do some good. i was a pilot in afghanistan, got into this weird place brought on by i don't know what..maybe the sexual abuse as a child, the beatings, the rape as a 3 year old. i don't know why I'm f'd up, I'm trying to do the right thing or decide if i should eat a bullet..im not trying to garnish sympathy, I've been brutally honest and yes i hate myself and have all my life, so get in line...btw, your are right! i loaded the gun for the photographers!

Please. For your own good and for the good of society, talk to a mental health professional. You're going to continue to be in that dark place until you get some help. I give you credit for realizing that what you did was wrong - many people who commit the same crime you did, do not. You definitely need a lawyer and they don't come cheap. But you need psychological help as well, not only to determine why you did what you did, but also to deal with your guilt at having done it.

I've just got off of anti depressants (6 weeks of detox) didn't want togo thru that in prison. i went to one sphycologist and when i was walking into his office for the second time, his secretary announced on the intercom "Dr. Cantor, your 2 o'clock pervert is here" that kind of put me off on getting $150 /hr help. the only reason i told you that story is to let you know how these be people can be. its a big fat $150 an hour (actually 50 minute a session) joke for them

You should have been on the phone to the germane state licensing agency immediately. That is not only unethical, it boarders on illegal.

btw: since you are military, why were you not availing yourself of the FREE psychological treatment available to you?

riper, I'm not taking jabs at you. What you did was really wrong but I do not know you personally so I have not commented on you, just your actions and even then I have not been mean.

You need to speak with a lawyer that can assist you with this. Given your history and this is all around returning from active deployment, there are some defenses available not available to the average citizen.

What is it that you would like us to tell you? It's kind of hard to answer your questions when all you do is beat up on yourself.
