My question involves criminal law for the state of: Florida
My son was stopped for speeding (64 in a 55) and the Officer suspected that he had been drinking based on odor and bloodshot eyes. My son admitted that he had been drinking and had 4 Field Sobriety tests performed. He then refused a breath test. He asked the officers what the difference would be if he did one or not and they told him that they could not give him legal advice. They searched his car and wallet and found an altered id. He was arrested and jailed, charged with dui and possession of an altered id. We bonded him out for $600. What are the chances that he will be sentenced to jail?
