My question involves real estate located in the State of: ohio
We share 50/50 driveway with neighbor. It's the only way to get to the garages. So our 22 year old neighbor put a 4 foot fence right along his side of the drive. The problem is the last post lines up directly with the back corner of my house. It's 6 feet from fence to house. So if you have a truck, you won't hit your mirror on the fence. If you're in a car, you have to dirve on the sidewalk that abuts my house, and is not reinforced for traffic. We had to get rid of a trailer b/c we had 6" on each side to get it in and out of drive. He tried to put a post in the center of the drive, which my husband told him hea couldn't do that b/c neither of us could use the garages. The city of Columbus told me he could put it there if it was on his porperty line.
So what can I do? Thought about driveway easement violation but I can;t find any paperwork on it. My survey of the land doesn't show one. If he would just move that post, everything would be fine. It's right on the edge, actually goes over the edge of the drive which is 5 ft wide.
He moved out in Dec. and bought a new house in another part of city. We've had to file with the city of Columbus for lawn mowing and weeds(lawn is over 4 ft in back yard), he tore out dog pee carpet and left it on front porch for 4 months. Now he plans to rent the house out! We had to mow his lawn when he lived there! All the other neighbors are unhappy with him too.
So any help would be greatly appreciated. Thank you
