Default Re: Dissatisfied With Outcome of Breast Augmentation, Surgeon's Recommendations

Wow..what a fun group you all are.

Let me clarify to the previous poster that I am/was EXTREMELY enthusiastic about my surgery. No one held a gun to my head. I could afford my surgery - paid in full, out right - what i cant afford is to pay for additional surgery to correct a mishap on my surgeons part that was 100% avoidable with a lift, (which I DID NOT have anything against) It is expected that an experienced surgeon (like he is) would AT LEAST offer a clear picture of the possible outcome without the lift..fairly educating the patient prior to surgery - which he did not. I came here looking for helpful advice. If someone had started by explaining that, with cosmetic surgery, "you drop the responsibility squarely on your lap" from the start, i would have had a better understanding of my "case" (or lack thereof) from the start. I am not refusing to understand anything, as the previous poster has accused. Quite the opposite, hence the reason i am posting my questions. Explain so that I understand it, rather than telling me I have a case of 'buyer's remorse' or that I got in too deep with a surgery that I wasn't 'enthusiastic about' or that I 'couldn't afford' ..

Unbelievable. Many of the jabs at my confusion could have been avoided if someone could have been kind enough to EXPLAIN, from the start, how it works when dealing with cosmetic surgery...

Really? So who wrote this in your original post?

I was not comfortable getting surgery to begin with

I couldn't afford this surgery the first time around

The point remains, you were immediately told that if a med mal attorney wouldn't take your case, it was because you didn't have one. You were further told that issues of complications were covered in the informed consent paperwork that you signed. That you continued to insist that there "HAS to be" something else you can do does not mean that no one here knew what they were talking about.

You just didn't like the answer. That would appear to be your problem, not ours.

Tell me about it. And really, talk about First World Problems!

My dear friend had to have surgery in 2004 to remove a cyst from his spinal cord. He literally walked to the hospital...and has been wheelchair bound ever since the surgery. No med mal attorney would take his case, either, because the surgery was clearly risky even under the best of circumstances, and he signed the paperwork stating that he understood that.

And this one is mad about breasts?

Yes, not comfortable with any surgery - of any kind - ever. Who looks forward to the actual surgery? Do i feel uncomfortable getting augmentation or have buyers remorse after doing so? No. And that is what was meant. No one wants to spend money and not get what they paid for. Money doesnt flow out of my ass, and that much money could be spent elsewhere so, no, its not actually something i can afford in that regard. Do we have the money to do it? Yes. Are we broke now because of it? Hell no. The point is that after its all said and done, i have to spend more money because my surgeon said "no, you dont need the lift." They should at least fix it for free. If it was your breasts or someones wife's breast, maybe you'd see my point slightly different, even if at the end of the day there was no legal recourse. Helping people understand the WHYS would be my suggestion to contributors on this sight. I never suggested anyone on here didnt know what they were talking about. Perhaps i was needing to understand that when dealing with cosmetic surgery the "rules" are slightly different. I knew med mal wasnt a likely option and hoped (in vain) that someone would explain "you can possibly try this or that", or even " because of the nature of the type of surgery, unfortunately you're shit out of luck". Yes i was told there was no med mal option, but i did not realize a civil suit would be one in the same for this, which was the purpose for my response at that point to all the 'you don't have a med-mal case here' type responses., at which point I pressed on about a civil case (not knowing that wasn't an option yet) Once that was pointed out I could have been satisfied that at least I got my questions answered and dealt with it. I continued to respond to the unnecessary, not to mention incorrect, comments about "refusing to understand" and "buyers remorse". We could parse words all day, im done. I have to say, I would not recommend this sight to anyone due to the unwelcoming nature of your approach at answering questions to people who dont already have an understanding of the law.

To the chic who commented about first world problems..screw you. Of course there are much bigger problems in this world. I know this first hand, thank you very much. However, when you PERSONALLY have a situation that needs dealt with, OBVIOUSLY you pursue it. Shall I ignore my issue and not pursue a resolution because it's not life threatening or something similar? I think not. I'm sure if the roles were reversed for any of you, you'd be looking at your options and exhausting all efforts as well.

You wanted the law explained to you. I explained the law as well as the economics of malpractice litigation. If you presented facts that pointed to a "this or that" (whatever that may be) instead of the law as presented, I would have commented on that as well. If you were confused and didn't realize that a malpractice lawsuit was a civil lawsuit, I'm sorry I didn't recognize your confusion.

If you prefer to argue about issues other than the law, I don't suppose I can stop you. But the problem seems to have transitioned somewhere along the line from, "Can somebody explain the law," to "I don't like your answer."

If you don't want to respond to the personal stuff, don't. It's as easy as that.
