Exclamation Father's Rights to See a Child or Oppose Adoption
ok so im 16 and i got pregnant when i was fifteen, i graduated early from high school and im currently attending a community college but i dont want the father to have anything to do with my childs life. he is currently in jail but is coming out soon and wants to at least see the child when he wants. he is 18 but was 17 when i got pregnant. all i want is whats best for my child and knowing the kind of person he is hes not it. im willing to let him at least see the child but my parents dont want that at all. im most likely not going to name him on the birth certificate but im scared that he will make my life hell and try to take my baby. i want to know if there is anything he can legally do to see my baby if his name isnt on the birth certificate. also my mom told me that she was going to adopt my child or something like that. i also wanted to know if i said it was ok for them to adopt my baby would the father still be able to do anything legally to see it.

You can't name him on the birth certificate if he is not there and does not sign himself.
If he wants to see his child, all he has to do is file to establish paternity with the court. Once this is done, he can sign the birth certificate and file for visitation with the child.
There is nothing your parents can do legally in this situation. They cannot adopt the child without his consent.

so he can legally make me take a paternity test?? and how could i get sole custody?

yes if he files a paternity action and establish paternity. that also means he will be held responsible for child support, and can visit the child.

you can ask for sole custody in court--the court will decide whether it is in the child's best interests for you to do so.

check for local support offices for assistance...
